1. Agreement and scope
These Terms of Use form an agreement between Voxen and the person or organisation that accesses the Voxen website or uses a service that refers to these terms. By accessing or using the website or services, you agree to these terms.
A proposal, order form, subscription document, service agreement, data-processing agreement, or other written agreement may contain additional or different terms. If there is a conflict, the signed agreement will control for the services it covers.
If you do not agree to these terms, do not access or use the relevant website or service.
2. Eligibility and authority
You must be legally capable of entering into a binding agreement. If you use Voxen for a business or another organisation, you represent that you are authorised to accept these terms and provide instructions on its behalf.
The services are intended for business use unless Voxen expressly states otherwise. They are not directed to children, and you must not knowingly use them to collect information from children in a way that violates applicable law.
3. Accounts and access
You are responsible for information submitted through your account, maintaining the confidentiality of credentials, and all activity conducted under authorised access. Use accurate account information and promptly update it when it changes.
Do not share credentials outside authorised users. Notify Voxen promptly through hello@voxen.tech or another official support channel if you suspect loss, compromise, or unauthorised use. Voxen may require authentication or other reasonable steps before changing account access.
4. Services and changes
Voxen may provide websites, voice-based systems, call-handling workflows, integrations, communications, support, and related functionality. The features available to a customer depend on its plan, configuration, location, integrations, and applicable agreement.
We may improve, update, replace, or discontinue features. Where a change materially affects a paid service, any notice or remedy will be governed by the applicable agreement and law. Preview, beta, or trial features may be changed or withdrawn and may be subject to additional limitations.
5. Customer responsibilities
You are responsible for:
- providing accurate, current business information and call-handling instructions;
- reviewing greetings, answers, routing rules, permissions, and escalation paths;
- testing workflows before sending production calls or customer data to them;
- maintaining a reasonable fallback for urgent or failed calls;
- ensuring that users and transfer recipients are authorised;
- complying with laws governing calls, recordings, transcripts, messages, marketing, and privacy;
- providing notices and obtaining consents required from callers or other individuals; and
- avoiding the collection of information that is unnecessary for the configured purpose.
Voxen does not determine whether your particular use is lawful, regulated, or suitable for a specific professional obligation. You should obtain appropriate advice for healthcare, financial, legal, emergency, employment, or other sensitive use cases.
6. Acceptable use
You must not use the website or services to:
- break the law, infringe rights, deceive, harass, threaten, or cause harm;
- make unlawful or unsolicited calls or messages;
- impersonate a person or misrepresent the nature of an automated interaction;
- collect credentials, payment details, or sensitive information without appropriate authority and safeguards;
- introduce malware, probe vulnerabilities, bypass access controls, or interfere with service operation;
- reverse engineer or extract protected parts of the service except where law expressly permits it;
- resell or provide unauthorised access to the service; or
- use the service in a way that creates unreasonable technical, legal, or security risk.
We may investigate suspected misuse and restrict or suspend access where reasonably necessary to protect users, third parties, Voxen, or the service.
7. AI and automated systems
Automated and AI-assisted systems can misunderstand speech, generate incomplete or incorrect responses, or fail to complete an intended action. You must review whether the configured service is appropriate for each use case and must not rely on it as the sole method for emergency response, professional advice, or decisions that may create serious harm.
You are responsible for defining approved information, permissions, routing rules, and situations that require human review. Callers should have a reasonable next step when the automated system cannot safely or reliably handle a request.
8. Third-party services
The services may connect with telecommunications providers, calendars, messaging tools, customer systems, payment providers, or other third-party services. Their availability, security, data practices, and terms are controlled by their providers.
You are responsible for maintaining authorised third-party accounts and permissions. Voxen is not responsible for third-party changes or failures except to the extent expressly stated in an applicable agreement.
9. Fees and payment
Fees, usage limits, taxes, billing periods, renewal terms, and cancellation arrangements are specified in the applicable order, plan, or service agreement. You authorise the agreed payment method and are responsible for charges incurred under your account.
Except where an agreement or applicable law provides otherwise, amounts paid are not refundable. We may suspend a paid service for overdue amounts after any required notice.
10. Intellectual property
Voxen and its licensors retain rights in the website, services, software, branding, documentation, and related materials. Subject to these terms and payment of applicable fees, Voxen grants you a limited, non-exclusive, non-transferable right to use the relevant service for authorised business purposes during the applicable term.
You retain rights in content and business information you provide. You grant Voxen the rights reasonably necessary to host, process, transmit, and use that material to provide, secure, support, and improve the contracted service, subject to the applicable agreement and Privacy Policy.
If you provide feedback, you permit Voxen to use it without restriction or compensation, provided that doing so does not identify you publicly without permission.
11. Disclaimers
To the maximum extent permitted by law, the website and services are provided “as is” and “as available.” Voxen disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from a course of dealing.
We do not warrant uninterrupted or error-free operation, that every call or phrase will be understood, that every integration will remain available, or that automated output will always be accurate. Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, business opportunities, or data, arising from these terms or the services, even if advised that such loss was possible.
Any aggregate liability cap, exclusions, service credits, or remedies applicable to a paid service should be stated in the relevant written agreement. Nothing in these terms limits liability that cannot lawfully be limited, including liability arising from fraud or other matters where exclusion is prohibited.
13. Termination and general terms
You may stop using the website at any time. Subscription termination, data export, deletion, and post-termination access are governed by the applicable plan or agreement. Voxen may suspend or terminate access for material breach, unlawful use, security risk, or nonpayment, subject to any required notice and cure rights.
Provisions that by their nature should survive termination—including payment obligations, ownership, disclaimers, liability limitations, and dispute terms—will continue to apply.
You may not assign these terms without Voxen’s consent, except as permitted in a written agreement. Voxen may assign them in connection with a reorganisation, financing, merger, acquisition, or transfer of the relevant business. If part of these terms is unenforceable, the remaining terms will continue to apply. A failure to enforce a provision is not a waiver.
Governing law, courts, arbitration, and dispute procedures will be those specified in the applicable written agreement. If no written agreement specifies them, these matters will be determined under applicable law and should be confirmed by Voxen before publication.
We may update these terms to reflect changes in law, services, or business practices. The date at the top shows the latest revision. Questions should be sent to hello@voxen.tech, submitted in the relevant account, or made through the method in your service agreement.
